Whittier oil project heads toward settlement talks

City's attorney: 'There is a lot of money on the table. Perhaps that might meet everybody's needs'

The left-for-dead Whittier oil project could be heading back on track.

In a surprise move, the Mountains Recreation and Conservation Authority has asked Whittier and Los Angeles County to sit down and discuss a settlement.

"It would be nice if everyone could figure out a way to make the litigation go away," said James Goldman, the attorney for the MRCA, the large, Santa Monica-based conservancy that won its case against Whittier in June that resulted in a permanent injunction against oil drilling in the 1,280-acre Whittier Hills Nature Preserve.

The MRCA, the county and its partner, the Los Angeles County Regional Park and Open Space District, and Whittier's partners, Matrix Oil Corp. and Clayton Williams Energy, Inc., indeed will be back in court on July 30 for a settlement conference. Heading up the settlement talks will be Los Angeles Superior Court Judge Louis M. Meisinger, a settlement judge.

Goldman would not discuss whether the MRCA would be asking for cash in order to allow the project to go forward. "I don't want to comment on what anyone might ask for," he said Monday. "The process doesn't work unless it is confidential."

While the judge cannot force a settlement, it appears likely that all sides will be talking about how to make the case go away.

The settlement conference

comes after Superior Court Judge James Chalfant on June 13 ordered all drilling operations to clear out in 10 days, saying Whittier and its partners acted in violation of an agreement to keep the land as a nature preserve in perpetuity. Chalfant, in a sweeping 38-page ruling, said the city could not drill for oil on land that was purchased using monies raised through Proposition A. The 1992 ballot measure, approved by 64 percent of the county's voters, required land be purchased for habitat preservation, open space and parks. He ruled Whittier was in violation of an agreement to keep land purchased with $9.3 million of Prop. A funds as a nature preserve and that any other development would violate the public's trust.

Whittier, which had to order Matrix to remove its heavy equipment from the land preserve at the end of Catalina Avenue near Friendly Hills, is delighted that the talks are back on. The city's attorney said the best possible outcome for Whittier and its partners is for a judge to lift the injunction and allow the project to go forward.

"We thought it was a good idea," said James Markman, the city's lead attorney on the case, referring to the upcoming conference in front of the mediator. He said Matrix Oil's attorney also will be at the settlement conference.

"There is a lot of money on the table," Markman said. "Perhaps that might meet everybody's needs."

Markman is so confident that talks will be fruitful that he has carved out two days on his schedule, instead of just one.

Said Goldman: "I suspect it will not go any more than one day."

Normally, settlement conferences occur toward the beginning or middle of a case. This case, filed in February 2012, has been heard in court on several occasions, once for a temporary injunction in January, and later on its merits. Markman has repeatedly suggested that the MRCA would settle for some amount of cash instead of sticking to its principles.

"I'm sure there will be a substantial amount of money involved" during the talks, Markman said.

Whittier has forecasted annual royalties from the project of about $100 million for 10 years, which would bring the city $1 billion. City Councilman Bob Henderson put the estimate even higher, at $1.5 billion. The estimates were in line with the high end of estimated royalties of oil, which is selling at more than $100 a barrel, according to Mike McCaskey, vice president of Matrix Oil Corp. and a 2011 environmental impact report.

One problem for Whittier and Matrix could be the county, which seems less likely to negotiate.

When the attorney for the county was asked about the settlement conference, he said he had nothing to say.

"I will need to check with Los Angeles County," said Sean Riley, of Glaser, Weil, Fink, Jacobs, Howard, & Shapiro, an outside law firm hired by the county to handle the case.

Sources on both sides of the case said the county was reluctant to go along with the settlement conference, but must attend because it was ordered to do so by the court. "Everybody agreed except for the county," Goldman said Monday.

Markman has repeatedly called the county "unwilling" to negotiate. He hinted that part of the reason could be that whatever the county's lawyers agree to must be approved by the Los Angeles County Board of Supervisors, making the county's participation "more political" than the MRCA's.

What could be bringing the MRCA to the table is the promise of dollars to purchase other plots of land for future preservation. Also, if the oil drilling was allowed to go forward, Matrix would have to spend $15 million on land it would purchase elsewhere, to make up for damaging the seven acres needed for drilling in the Whittier nature preserve.

Markman said the MRCA is a "savvy organization" that is accustomed to making deals. That is true, especially if one includes its parent, the Santa Monica Mountains Conservancy, the largest conservancy in Southern California. It owns and manages public lands in the western portion of the county. He said Whittier has spoken to the MRCA about the "environmental value" of making a deal.

He also compared the oil and gas drilling project in the Whittier Hills to the SMMC renting out open space for celebrity weddings.

"This is not a foreign notion, using open space for other purposes," Markman said.

If there is no settlement, then most likely the court's final order will be issued. That would likely trigger an appeal by the city of Whittier and Matrix. "We have appealable issues," Markman said.

If a settlement is reached, it would not be the first time a plaintiff against the project had reached a settlement with the city. Last fall, the city settled with the Open Space Legal Defense Fund, a neighborhood group that fought the oil project for two years in court. The group's attorney said they settled in order to allow MRCA and SMMC to move the case forward unfettered.

"It depends on the positions of the parties. It could be a big waste of time," said Geralyn Skapik, who represented OSLDF in the old case. She said the city and Matrix could see the MRCA and SMMC as hurdles to overcome, just like they did the Open Space Legal Defense Fund case.

However, getting past the county Board of Supervisors may be more difficult, she said. Already, Supervisor Gloria Molina has told this newspaper she would vote against oil drilling in the Whittier hills nature preserve.

"My preference is no drilling in open space," she said in June.

No gorings in 2nd bull run of Spain's San Fermin

PAMPLONA, Spain (AP) ? Thousands of daredevils raced through the streets of the northern Spanish city of Pamplona in a hair-raising but relatively clean second bull run of the famed annual San Fermin festival.

Navarra Hospital chief Javier Sesma said there were no gorings in the run Monday and four people were treated in city hospitals for injuries suffered in falls.

The early morning race, which sees thrill-seekers dashing alongside six fighting bulls, lasted just over two minutes.

The nine-day fiesta immortalized in Ernest Hemingway's novel "The Sun Also Rises" is one of Spain's main tourist attractions.

(AP) ? After nearly 11 hours in the air, the passengers and crew aboard a jumbo jetliner traveling from Seoul to San Francisco were looking forward to a quick and uneventful landing as Asiana Airlines Flight 214 approached the airport from over San Francisco Bay. What they got instead, without a word of warning, was terror, panic and confusion.

The Boeing 777 slammed into the runway on Saturday morning, breaking off its tail and catching fire before slumping to a stop that allowed the lucky ones to flee down emergency slides into thick smoke and a trail of debris. Firefighters doused the flames that burned through the fuselage with foam and water, and police officers on the ground threw utility knives up to crew members so they could cut the seat belts of those who remained trapped as rescue crews removed the injured.

By the time the 307 people on the flight all were accounted for several hours later, two people found outside the wreckage had been confirmed dead and 182 transported to area hospitals. But as harrowing as the crash was, survivors and witnesses were just as stunned to learn that the toll of deaths and serious injuries wasn't much higher.

"When you heard that explosion, that loud boom and you saw the black smoke...you just thought, my god, everybody in there is gone," said Ki Siadatan, who lives a few miles away from San Francisco International Airport and watched the plane's "wobbly" and "a little bit out of control" approach from his balcony. "My initial reaction was I don't see how anyone could have made it."

Vedpal Singh, who was sitting in the middle of the aircraft and survived the crash with his family, said there was no forewarning from the pilot or any crew members before the plane touched down hard and he heard a loud sound.

"We knew something was horrible wrong," said Singh, who suffered a fractured collarbone and had his arm was in a sling.

"It's miraculous we survived," he said.

A visibly shaken Singh said the plane went silent before people tried to get out anyway they could. His 15-year-old son said luggage tumbled from the overhead bins. The entire incident lasted about 10 seconds.

Another passenger, Benjamin Levy, 39, said it looked to him that the plane was flying too low and too close to the bay as it approached the runway. Levy, who was sitting in an emergency exit row, said he felt the pilot try to lift the jet up before it crashed, and thinks the maneuver might have saved some lives.

"Everybody was screaming. I was trying to usher them out," he recalled of the first seconds after the landing. "I said, 'Stay calm, stop screaming, help each other out, don't push.'"

San Francisco Fire Department Chief Joanne Hayes-White said she did not know the ages or genders of the two people who died, but said they were found on "the exterior" of the plane. "Having surveyed that area, we're lucky that there hasn't been a greater loss," she said.

Airport spokesman Doug Yakel said 49 people were critically injured and 132 had less significant injuries.

The flight originated in Shanghai, China, and stopped over in Seoul, South Korea, before coming to San Francisco, airport officials said. The airline said there were 16 crew members aboard, and the 291 passengers included 77 South Koreans, 141 Chinese, 61 Americans and one Japanese citizen. The nationalities of the remaining passengers weren't immediately known.

San Mateo County Coroner Robert Foucrault told the San Jose Mercury News the two dead passengers were 16-year-old females and that one appeared to have been thrown from the rear of the plane when the tail broke off, and the other was found near the wreckage. The official Chinese news agency Xinhuah, quoting the Chinese Consulate in San Francisco, said both victims were from China.

At least 70 Chinese students and teachers were on the plane heading to summer camps, according to education authorities in China.

Based on witness accounts in the news and video of the wreckage, Mike Barr, a former military pilot and accident investigator who teaches aviation safety at the University of Southern California, said it appeared the plane approached the runway too low and something may have caught the runway lip ? the seawall at the end of the runway.

San Francisco is one of several airports around the country that border bodies of water that have walls at the end of their runways to prevent planes that overrun a runway from ending up in the water.

Since the plane was about to land, its landing gear would have already been down, Barr said. It's possible the landing gear or the tail of the plane hit the seawall, he said. If that happened, it would effectively slam the plane into the runway, he said.

Noting that some witnesses reported hearing the plane's engines rev up just before the crash, Barr said that would be consistent with a pilot who realized at the last minute that the plane was too low and was increasing power to the engines to try to increase altitude. Barr said he could think of no reason why a plane would come in to land that low.

Kate Belding was out jogging just before 11:30 a.m. on a path across the water from the airport when she noticed the plane approaching the runway in a way that "just didn't look like it was coming in quite right."

"Then all of a sudden I saw what looked like a cloud of dirt puffing up and then there was a big bang and it kind of looked like the plane maybe bounced (as it neared the ground)," she said. "I couldn't really tell what happened, but you saw the wings going up and (in) a weird angle."

Four pilots were aboard the plane and they rotated on a two-person shift during the flight, according to The Ministry of Land, Infrastructure and Transport in South Korea.

The two who piloted the plane at the time of crash were Lee Jeong-min and Lee Gang-guk and they are both veteran pilots, a ministry official said on condition of anonymity because he wasn't authorized to speak to media.

Asiana is a South Korean airline, second in size to national carrier Korean Air. It has recently tried to expand its presence in the United States, and joined the Star Alliance, which is anchored in the U.S. by United Airlines.

The 777-200 is a long-range plane from Boeing. The twin-engine aircraft is often used for flights from one continent to another because it can travel 12 hours or more without refueling.

The most notable accident involving a 777 occurred on Jan. 17, 2008 at Heathrow Airport in London. British Airways Flight 28 landed hard about 1,000 feet short of the runway and slid onto the start of the runway. The impact broke the 777-200's landing gear. There were 47 injuries, but no fatalities.

Saving The Union At Gettysburg

West Virginians may well have played a critical role in saving the Union during the Civil War battle at Gettysburg, Pa.

While we West Virginia residents were celebrating the sesquicentennial of our state's birth, most history buffs were focusing on the 150th anniversary of the Gettysburg fight. Re-enactments including thousands of blue- and gray-clad "soldiers" were held last week.

Most Americans probably think of Gettysburg as the battle that turned the tide during the Civil War. Indeed, during a two-week period in 1863, it became clear the Confederacy's back had been broken.

First, on June 20, West Virginia was born, rending the Old Dominion, the Confederacy's most powerful state, asunder. Then, on July 3, Confederate Gen. Robert E. Lee admitted defeat at Gettysburg. Finally, on July 4, the Confederate bastion at Vicksburg, Miss., fell, cutting the rebel nation in two.

Few people really know much about Gettysburg, except for Pickett's Charge. It certainly was, as some have called it, the high tide of the Confederacy.

But a critical fight occurred the previous night on Cemetery Hill, at the right of the Union army's line of battle. There, thousands of rebel troops nearly broke through the boys in blue. Had they completed the assault, the entire Union Army might have crumbled.

Screaming the rebel yell, Confederates swarmed up the hill and got as far as the Union artillery, where vicious hand-to-hand fighting occurred. The situation was grim, when Union reinforcements - three small regiments including the 7th West Virginia - were called in.

Let one of the West Virginians tell what happened:

"On arriving there we found the Battery about to be taken charge of by the enemy who were in large force. Whereupon we immediately charged on the enemy and succeeded in completely routing their entire force and driving them beyond our lines."

With their comrades from Ohio and Indiana, the Mountain State boys prevented a Union defeat on Cemetery Hill. So yes, it may well have been West Virginians - most from this area of the state - who saved the union that night in 1863.

There's an impressive monument to them at the site of their triumph. The first line of the inscription notes the monument honors "Sons of the Mountains."

Survivor: Announcement said plane had landed safely

Moments after Asiana Airlines flight 214 stopped its violent crash landing, a voice came over the plane's intercom to say it had landed safely and everyone should stay in their seats, a passenger told ABC News.

Within minutes, however, flames could be seen outside the plane's windows and smoke was seeping into the cabin.

Lee Jang-Hyung, 32, was sitting with his wife Lee Ji-Young, 33, and his toddler son who is 15 months old in the front row of the plane's economy class section. His parents-in-law were sitting in business class.

Hyung said he and his family survived the crash without injury, but he was clearly shaken by the harrowing close call.

"Just minutes before landing, I looked out the window and realized the plane's angle was strangely tilted. The seawater level did not look right," said Hyung, a Korean citizen who lives near Berkeley. His wife is an American citizen.

"Suddenly, the plane's tail part hit the ground and the aircraft bounced upwards and then bam, it hit the ground again. This time it felt like the entire plane hit parallel, but tilted to the left. That pressure was huge. Very strong. I saw luggages fall from the top. And the plane gradually stopped.

"Until then, there was no warning. The drop happened without a warning," he said.

Still stunned by the crash, he said, "We heard an announcement saying the plane has safely landed and everyone should stay put."

Hyung said he put on an oxygen mask that had dropped down and put another on his young son and ran to the door.

"But I was turned back to my seat by the flight attendants. Right when I came back to my seat, I saw smoke and fire outside the right window. The flames were spreading and smoke started to come inside the aircraft. I grabbed my wife and son and ran to the exit door. By then, they had slides ready," he said.

San Francisco Fire Chief Joanne Hayes White said that when the first fire units arrived, three chutes were deployed and passengers were sliding down to evacuate the plane.

"My parents-in-law were on business class and they told us that they saw a stewardess hurt. When the plane made the second crash and all fell loose, some sort of computer machinery fell from the ceiling on top of her when she was sitting at the flight attendants' seat by the door," Hyung said.

"People were trying to help her, they said. My mother-in-law is injured.... both are bruised by luggage that spilled out," he said.

The ordeal didn't end after their evacuation Hyung said he was somewhere in the airport, but he didn't know where.

"They put us on some sort of cargo elevator and we are somewhere at a dirty smelly place. I had to wait five hours with no diapers and no food. After complaining hard, the authorities finally just brought me diapers," Hyung said.

He said the injured were taken to hospitals, but the other passengers "are all waiting for directions."

Later, they were moved to a more pleasant lounge and given crackers and fruit. But they were told that everyone on the plane had to be interviewed by the FBI before they could be allowed to leave.

Pope Francis clears John Paul II for sainthood

VATICAN CITY (AP) ? Pope Francis on Friday cleared Pope John Paul II for sainthood, approving a miracle attributed to his intercession and setting up a remarkable dual canonization along with another beloved pope, John XXIII.

In a major demonstration of his papal authority, Francis decided to make John XXIII a saint even though the Vatican hasn't confirmed a second miracle attributed to his intercession. The Vatican said Francis had the power to "dispense" with the normal saint-making procedures to canonize him on his own merit, without a miracle.

The ceremonies are expected before the end of the year. The date of Dec. 8 has been floated as one possibility, given it's the feast of the Immaculate Conception, a major feast day for the church. Polish media continued to report that October was likely, to mark the anniversary of John Paul's election, but Vatican officials have said that's too soon to organize such a massive event.

The Vatican spokesman, the Rev. Federico Lombardi, confirmed that the miracle that brought John Paul to the ranks of sainthood concerned a Costa Rican woman.

The Spanish Catholic newspaper La Razon has identified her as Floribeth Mora, and said she suffered from a cerebral aneurism that was inexplicably cured on May 1, 2011 ? the day of John Paul's beatification, when 1.5 million people filled St. Peter's Square to honor the beloved Polish pontiff.

In a series of reports late last month, La Razon reported that Mora awoke with debilitating head pain on April 8 and went to the hospital, where her condition worsened to the point that she was sent home with only a month to live.

Her family prayed to John Paul, and the aneurism disappeared.

La Razon quoted her doctor, Dr. Alejandro Vargas, who said: "It surprised me a lot that the aneurism disappeared, I can't explain it based on science."

The Associated Press has traveled to Mora's home in Costa Rica but has been told that she is bound by secrecy and cannot discuss her case.

Then-Pope Benedict XVI put John Paul, who became pope in 1978, on the fast-track for possible sainthood when he dispensed with the traditional five-year waiting period and allowed the beatification process to begin weeks after his April 2, 2005, death. Benedict was responding to chants of "Santo Subito!" or "Sainthood Immediately" which erupted during John Paul's funeral.

But there remains some concern that the process has been too quick. Some of the Holy See's deep-seated problems ? clerical sex abuse, dysfunctional governance and more recently the financial scandals at the Vatican bank ? essentially date from shortcomings of his pontificate.

As a result, the decision to canonize John Paul along with John XXIII can be seen as trying to balance out those concerns, by beatifying one pope along with another.

Such was the case in 2000, when John Paul beatified John XXIII (1958-1963) , dubbed the "good pope," alongside Pope Pius IX, who was criticized by Jews for condoning the seizure of a Jewish boy and allegedly referring to Jews as dogs.

By canonizing John Paul II along with John XXIII, the Vatican could be seeking to assuage concerns about John Paul's fast-track sainthood case by tying it together with the 50-year wait since the death of John XXIII.

For at least three-quarters of the way, this is a fine film, and one that kids and parents could see together.

There is an enchanted-fairy-tale aspect to Mud, but its bright, calm surface only barely disguises a strong, churning undercurrent.

A modern fairy tale, steeped in the sleepy Mississippi lore of Twain and similar American writers, and with a heart as big as the river is wide.

Nichols has a strong feeling for the tactility of natural elements-water, wood, terrain, weather.

Nichols takes his time with the story, dwelling on how the boy is shaped by the killer's tragic sense of romance, yet the suspense holds.

"Mud" isn't just a movie. It's the firm confirmation of a career.

Mud is about the fragility of men, the craving to be loved - by a woman, by other men - and how easily that love is misplaced, taken away, cheated or lost.

Mud has a rare big-screen beauty, and its old-fashioned storytelling recalls A River Runs Through It, Night of the Hunter, and Stand By Me.

This moody, broody character-driven crime story is another fine step in the career redemption of Matthew McConaughey.

Mud is the kind of small scale, character driven drama one rarely sees out of the States any more, and cements Nichols as one of his country's most significant independent auteurs.

Just like its lead character, this film is packed to the brim with sadness, swagger and soul.

All the women in this movie are shrews, liars and/or emasculators.

Mud is a moving exploration into the nature of manhood, with superb performances, striking location and engrossing story creating a mesmerising and heartfelt coming of age drama.

A stripped back approach to tracking the process of growing up, but lacks the faith to see the plan executed to the end

Nichols takes his time unravelling Mud and Ellis's entwined fates, but his characters are so rich that it's well worth being in their company.

In its energy and nuance, Mud seems like the kind of film Hollywood would've made in the Seventies, and would've continued to do if not for the advent of market-conscious filmmaking.

More than a mere tribute to Twain and Dickens: this has all the makings of a modern classic.

An extremely sophisticated and progressive examination on how adolescent masculinity is defined by often-contradictory cultural attitudes towards femininity.

Mud is as beautiful to watch as it is to listen to, and feel kinship to, whether you're from the South or just Southern at heart.

In Jeff Nichols, America has a champion of the religious and working class. With the schism between the right and left in the U.S. growing ever larger... his ascent couldn't have come at a better time.

This is a film with a great naturalistic style and captivating performances and which does just about everything right.

Jeff Nichols writes characters with depth, nurtures strong performances form his cast and allows the screenplay's backwater setting to effectively create tone and texture.

This is American cinema at its very best as Huckleberry Finn meets Stand By Me.The two boys are terrific and McConaughey is sensational as Mud, dazzlingly frazzled as the hunted and haunted man on the run.

Up till just past the three-quarter mark, Mud is one heck of a nifty psychological fable.

The Southern-fried drama "Mud" is an electrifying example of what happens when you merge a crackerjack yarn with a very specific setting, and then pour on the heat with riveting performances.

Kim Dotcom's Mega launches Android app, vows iOS and Windows apps soon

Mega launches Android app

Kim Dotcom launched his Mega cloud storage platform with much fanfare, but few ways to use it. That's finally improving now that the Mega Android app is here. The release won't shock anyone who has used established rivals like Dropbox and Google Drive, but it is reasonably complete with two-way transfers, image previews and automatic camera syncing. It won't be alone for long, either. Mega says that both iOS and Windows apps are in the last stages of testing, which could give us more of an incentive to try what's still a very young service.

You may have already read our Sony Xperia Z Ultra hands-on last week, but since then we've also been able to spend a tiny bit more time with a pre-production unit (with firmware build 14.1.B.1.277). Instead of going over again how hilariously large this 6.4-inch, pen-friendly phone is, this time we'll focus on some early benchmark results, camera performance and Sony's very own UX features.

As you'll see after the break, many of the benchmark scores aren't too far off from what we saw on the MDP phone with the same Snapdragon 800 SoC, and the final units should be optimized with higher numbers. While we didn't manage to get CF-Bench and Quadrant running on the phone, the higher-than-before 3DMark score did cheer us up, meaning either Sony or Qualcomm's managed to fine tune the latter's new Adreno 330 GPU.

  1. Reshuffle your candies without losing lives Sometimes just by looking at a new level you know if you'll be in for an easy or a hard time. Luckily, there's a way to change that, and reshuffle a challenging level, without using up any of your lives. On your mobile device, open the level and then press the exit button before you make any moves. When you come back, the candy will be reshuffled and in new, hopefully easier to handle positions. You can do this as many times as you want and no lives will be lost. This trick does not work on the time challenges as the game has already started as the time counts down.

  1. Infinite lives on Facebook On your web browser you can keep multiple tabs open and on Candy Crush at the same time. This means that for those really hard levels you will never have to wait for lives to refresh as on each open version of Candy Crush you have 5 lives ready. When you do pass a level you will have to refresh each webpage but this is exceptionally helpful for those levels which take a lot of lives to pass. Below you can see I have 5 tabs open to Candy Crush and each with 5 lives. Yes, I stole Rene's facebook account to play Candy Crush on it.

  1. Time Challenge add time The trick to passing timed levels is getting as many +5 candies as possible to add more time to clock. Understanding why the +5 candies drop really helps as they do not just drop randomly. The +5's drop every time you make a move which causes a cascade of 4 or more combos. Then make sure you crush that +5 to add it to your timer. You increase your chances of creating a cascade by crushing candies at the bottom of the board as there are more candies above you to make a second, third and then fourth set. Try this on level 252 and you can play until you get bored of the level, I stopped when I hit 1,000,000 points and still had the full 30 seconds on the clock.

  1. Use striped candies strategically Do not waste your striped candies as soon as you get them. Try to plan out where they would be most beneficial and use them to reach those hard to get candies. There are some levels that this skill is essential for passing the level.

  1. Save your fish for last Fish candies will zone in on any remaining jellies. Save them for last so you can have them get those hard to reach jellies. They will also get rid of jellies which are under frosting blocks without needing to get rid of the frosting making passing levels even faster.

  1. Finish with extra moves left If you complete a level with extra moves left over they will transfer into more points as a school of jelly fish or striped candy will clear parts of the board. This does not guarantee that you will garner more points but usually it is a safe bet in order to hit those high scores

To use this on mobile, just play the level and the three extra moves are added automatically. If you are playing on the web on Facebook you can see the number of +3 moves you were given in the starting screen. You just click on the +3 moves in the starting screen to activate it.

  1. Gifts from friends You only have a maximum of 5 lives (or sometimes 6) so dont accept lives from your friends until you can use them. If you accept lives when you are already maxed out the lives are wasted. I use the X to close the screen and wait until I'm under 5 lives remaining to click accept. Also know that the level you happen to be on when you accept a +3 moves will be the level that gift must be used on. So I only accept a +3 moves gift on the levels I am really struggling with.

The exits look like small green circles with white arrows inside them.
